ENG - TERMS OF USE – PHOTO / VIDEO MATERIALS
1. Creative Approach and Artistic Style
The Photographer / Videographer retains full creative freedom and the right to exercise their own artistic style throughout the photography, filming, selection, editing and production of photo and video materials.
The final look and feel of the photographs and video materials are based on the Photographer’s / Videographer’s distinctive style and approach, as presented on their website, social media channels and other promotional materials.
The Client acknowledges that the Photographer’s / Videographer’s creative and documentary style is an integral part of the agreed service.
The Photographer / Videographer reserves the right to independently determine the approach to photography and filming, the selection of shots, photo editing and video production, in accordance with their professional and artistic standards.
2. Photography and Filming
The Photographer / Videographer will make every reasonable effort to capture the shots and moments requested by the Client.
However, the Photographer / Videographer cannot guarantee that every individual requested shot will be captured.
The final content of the photo and video materials may be affected by adverse weather conditions, limited time due to the organization and schedule of the event, the flow and dynamics of the wedding, guest behavior, lighting conditions, restrictions of the venue or location, and other circumstances beyond the Photographer’s / Videographer’s direct control.
The Client is responsible for informing the Photographer / Videographer in advance of any specific requests, important people and key moments they would like to have captured.
3. Selection and Editing of Photographs
The Photographer / Videographer independently selects the photographs that they consider to be of sufficient quality and appropriate for final delivery.
Photographs are edited in accordance with the Photographer’s / Videographer’s documentary and artistic style and generally include color, exposure, contrast, cropping, resizing and basic alignment corrections.
The Photographer / Videographer retains creative discretion in editing and selecting the photographs to be delivered, taking into consideration technical quality and their own artistic standards.
Unedited RAW files are not included in the final delivery unless otherwise expressly agreed.
The Photographer / Videographer reserves the right to exclude technically defective, duplicate, test or other photographs that do not meet their professional and artistic standards.
4. Video Materials
Video materials are edited and produced in accordance with the selected package and the Photographer’s / Videographer’s creative style.
The Photographer / Videographer independently selects the video footage to be included in the final film, taking into consideration image quality, continuity, atmosphere and overall artistic impression.
In the case of a highlight film, the final product represents a creatively edited and condensed story of the wedding rather than a complete recording of all events throughout the day.
Raw and unedited video footage is not included in the final delivery unless otherwise expressly agreed.
5. Additional Editing and Revisions
The delivery of photographs and video materials includes the editing specified in the selected package.
Any additional editing, requested changes to photographs, additional video editing, or revisions to an already completed video that are not included in the selected package may be charged separately in accordance with the current price list.
6. Copyright
The Photographer / Videographer retains the copyright to all photographs and video materials created in accordance with the applicable Croatian Copyright and Related Rights Act.
Delivery of the materials to the Client does not transfer copyright ownership of the photographs or video materials. The Client is granted the right to use the delivered materials for personal, non-commercial purposes.
7. Use of Materials by the Client
The Client may use the delivered photographs and video materials for personal purposes, including posting them on their personal social media profiles and sharing them with family and friends.
The Client may not sell, license, assign or distribute the delivered photographs or video materials to third parties for commercial or promotional purposes without the Photographer’s / Videographer’s prior written consent.
This specifically applies to the use or distribution of the materials by florists, wedding planners, hotels, restaurants, stylists, beauty salons, other service providers and businesses.
8. Promotional Use of Materials
The Client grants the Photographer / Videographer permission to use selected photographs and video materials created as part of the agreed service for their own professional promotional purposes.
The materials may be used for:
- website and portfolio
- social media
- advertising
- blog posts
- promotional materials
- exhibitions
- photography and video competitions
- other forms of showcasing the Photographer’s / Videographer’s work.
If the Client does not wish the Photographer / Videographer to use the photographs and/or video materials for the promotional purposes listed above, this request must be agreed upon in advance, and the service fee may be increased depending on the selected package.
Any use of the materials by the Photographer / Videographer that is not covered by these Terms of Use requires the Client’s prior written consent.
9. Storage and Archiving of Materials
Upon receiving the photo and video materials, the Client assumes responsibility for their storage, protection and archiving.
The Photographer / Videographer does not guarantee permanent storage or archiving of the delivered photographs and video materials.
The Client is strongly advised to create multiple backup copies of the delivered materials and store them on different physical and/or digital media.
The Photographer / Videographer is not responsible for the loss of materials after delivery or for any data loss occurring after the expiry of a reasonable storage period.
10. Delivery of Materials
Photographs and video materials are delivered in digital format and in the manner specified by the selected package.
Delivery may include an online gallery, download link, USB drive, physical album or other products specified in the selected package.
The delivery timeframe depends on the selected package and the amount of material and includes the time required for professional selection, editing, video production and preparation of the final materials.
Where included in the selected package, the sneak peek represents a selection of photographs delivered before the completion of the full editing process.
11. Technical Quality and Unforeseen Circumstances
The Photographer / Videographer takes reasonable measures to ensure the quality and security of the recorded materials.
Nevertheless, certain technical issues may occur due to circumstances beyond the Photographer’s / Videographer’s control, including equipment failure, memory card issues, data loss, unfavorable shooting conditions or other unforeseen technical circumstances.
In such situations, the Photographer / Videographer will take reasonable steps to prevent or minimize the consequences and, where possible, provide an alternative solution.
12. Limitations Regarding Photographs and Video Materials
Due to the nature of live event photography and filming, the final materials may contain photographs or video footage in which certain individuals do not appear, appear only partially, or are not captured at a particular desired moment.
The Photographer / Videographer cannot guarantee a specific number of photographs of individual persons, a specific number of photographs of particular moments, or specific video content, unless expressly stated in the selected package.
The final selection and presentation of the materials remain at the creative discretion of the Photographer / Videographer.
HR - UVJETI KORIŠTENJA – FOTO / VIDEO MATERIJALI
1. Kreativni pristup i umjetnički izričaj
Fotograf / Snimatelj zadržava pravo potpune kreativne slobode i vlastitog umjetničkog izričaja prilikom fotografiranja, snimanja, odabira, obrade i montaže foto i video materijala.
Konačni izgled fotografija i video materijala temelji se na prepoznatljivom stilu i načinu rada Fotografa / Snimatelja koji je prezentiran na njegovoj web stranici, društvenim mrežama i drugim promotivnim materijalima.
Naručitelj prihvaća da je kreativni i dokumentarni stil Fotografa / Snimatelja sastavni dio ugovorene usluge.
Fotograf / Snimatelj zadržava pravo samostalno odlučiti o načinu fotografiranja, snimanja, odabiru kadrova, obradi fotografija i montaži video materijala, u skladu sa svojim profesionalnim i umjetničkim standardima.
2. Fotografiranje i snimanje
Fotograf / Snimatelj će uložiti sav razuman napor kako bi osigurao kadrove i trenutke koje je Naručitelj zatražio.
Međutim, Fotograf / Snimatelj ne može jamčiti snimanje svakog pojedinačnog željenog kadra.
Na konačni sadržaj foto i video materijala mogu utjecati nepovoljni vremenski uvjeti, nedostatak vremena zbog organizacije samog događanja, raspored i dinamika vjenčanja, ponašanje gostiju, uvjeti osvjetljenja, ograničenja prostora ili lokacije te druge okolnosti na koje Fotograf / Snimatelj nema izravan utjecaj.
Naručitelj je odgovoran pravovremeno obavijestiti Fotografa / Snimatelja o posebnim željama, važnim osobama i trenucima koje želi posebno zabilježiti.
3. Odabir i obrada fotografija
Fotograf / Snimatelj samostalno odabire fotografije koje smatra kvalitetnima i prikladnima za konačnu isporuku.
Obrada fotografija provodi se u skladu s dokumentarnim i umjetničkim stilom Fotografa / Snimatelja te u pravilu uključuje korekciju boje, ekspozicije, kontrasta, kadra, veličine i osnovnog poravnavanja.
Fotograf / Snimatelj zadržava kreativno pravo pri editiranju i odabiru fotografija koje će biti isporučene, vodeći računa o tehničkoj kvaliteti i vlastitom umjetničkom standardu.
Neobrađene (RAW) fotografije nisu dio isporuke, osim ako nije izričito drugačije dogovoreno.
Fotograf / Snimatelj zadržava pravo izostaviti tehnički neispravne, duplicirane, testne ili druge fotografije koje ne zadovoljavaju njegov profesionalni i umjetnički standard.
4. Video materijal
Video materijal obrađuje se i montira u skladu s odabranim paketom i kreativnim stilom Fotografa / Snimatelja.
Fotograf / Snimatelj samostalno odabire video kadrove koji će biti uključeni u konačni film, vodeći računa o kvaliteti snimke, kontinuitetu, atmosferi i umjetničkom dojmu.
Kod highlight videa konačni proizvod predstavlja kreativno montiranu i skraćenu priču o vjenčanju, a ne cjelovitu snimku svih događanja tijekom dana.
Sirove i neobrađene video snimke nisu dio isporuke, osim ako nije izričito drugačije dogovoreno.
5. Dodatne izmjene i obrade
Isporuka fotografija i video materijala uključuje obradu navedenu u odabranom paketu.
Za sve dodatno tražene radove obrade, izmjene fotografija, dodatnu montažu ili izmjene već dovršenog video materijala koje nisu uključene u odabrani paket, Fotograf / Snimatelj može ispostaviti zaseban račun prema važećem cjeniku.
6. Autorska prava
Fotograf / Snimatelj zadržava autorska prava na izrađenim fotografijama i video materijalima u skladu sa Zakonom o autorskom pravu i srodnim pravima Republike Hrvatske.
Isporukom materijala Naručitelju ne prelaze autorska prava na fotografije i video materijale, već Naručitelj dobiva pravo korištenja isporučenih materijala za osobne, nekomercijalne potrebe.
7. Korištenje materijala od strane Naručitelja
Naručitelj može isporučene fotografije i video materijale koristiti za osobne potrebe, uključujući objavljivanje na vlastitim profilima društvenih mreža te dijeljenje s obitelji i prijateljima.
Naručitelj ne smije prodavati, licencirati, ustupati ili distribuirati isporučene fotografije i video materijale trećim osobama u komercijalne ili promotivne svrhe bez prethodnog pisanog odobrenja Fotografa / Snimatelja.
To se osobito odnosi na korištenje ili distribuciju materijala od strane cvjećara, organizatora vjenčanja, hotela, restorana, stilista, salona, drugih pružatelja usluga i poslovnih subjekata.
8. Promotivno korištenje materijala
Naručitelj dopušta Fotografu / Snimatelju korištenje odabranih fotografija i video materijala nastalih u okviru ugovorene usluge u svrhu vlastite profesionalne promocije.
Materijali se mogu koristiti za:
web stranicu i portfolio
društvene mreže
oglašavanje
blogove
promotivne materijale
izložbe
fotografska i video natjecanja
druge oblike predstavljanja rada Fotografa / Snimatelja.
Ako Naručitelj ne želi da Fotograf / Snimatelj koristi fotografije i/ili video materijale u navedene promotivne svrhe, takav zahtjev potrebno je unaprijed dogovoriti, a cijena usluge može biti uvećana ovisno o odabranom paketu.
Za svako korištenje materijala od strane Fotografa / Snimatelja koje nije obuhvaćeno ovim Uvjetima potrebna je prethodna pisana suglasnost Naručitelja.
9. Čuvanje i arhiviranje materijala
Nakon primitka foto i video materijala Naručitelj preuzima odgovornost za njihovo čuvanje, zaštitu i arhiviranje.
Fotograf / Snimatelj ne jamči trajno arhiviranje isporučenih fotografija i video materijala.
Naručitelju se preporučuje izrada većeg broja sigurnosnih kopija isporučenog materijala i njegovo čuvanje na različitim fizičkim i/ili digitalnim medijima.
Fotograf / Snimatelj nije odgovoran za gubitak materijala nakon njegove isporuke niti za eventualni gubitak podataka nastao nakon isteka razumnog roka za pohranu.
10. Isporuka materijala
Fotografije i video materijali isporučuju se u digitalnom formatu i na način definiran odabranim paketom.
Isporuka može uključivati online galeriju, poveznicu za preuzimanje, USB uređaj, fizički album ili druge proizvode navedene u odabranom paketu.
Rok isporuke ovisi o odabranom paketu i količini materijala te uključuje vrijeme potrebno za profesionalni odabir, obradu, montažu i pripremu materijala.
Sneak peek materijal, kada je uključen u paket, predstavlja izbor fotografija koji se isporučuje prije završetka cjelokupne obrade.
11. Tehnička kvaliteta i nepredviđene okolnosti
Fotograf / Snimatelj poduzima razumne mjere kako bi osigurao kvalitetu i sigurnost snimljenog materijala.
Unatoč tome, određeni tehnički problemi mogu nastati zbog okolnosti izvan kontrole Fotografa / Snimatelja, uključujući kvar opreme, probleme s memorijskim karticama, gubitak podataka, nepovoljne uvjete snimanja ili druge nepredviđene tehničke okolnosti.
Fotograf / Snimatelj će u takvim situacijama poduzeti razumne korake kako bi spriječio ili ublažio posljedice i, gdje je moguće, osigurao alternativno rješenje.
12. Ograničenja u vezi s fotografijama i video materijalima
Zbog prirode fotografiranja i snimanja događanja uživo, konačni materijal može sadržavati fotografije ili video zapise na kojima se pojedine osobe ne pojavljuju, pojavljuju djelomično ili nisu snimljene u željenom trenutku.
Fotograf / Snimatelj ne može jamčiti određeni broj fotografija pojedinačnih osoba, određeni broj fotografija određenih trenutaka ili točno određeni sadržaj video materijala, osim ako je to izričito navedeno u odabranom paketu.
Konačni izbor i prezentacija materijala ostaju u domeni kreativne procjene Fotografa / Snimatelja.
